Henry Noye Secures a Dismissal of a Suit in Defense of a Client

On March 6, 2024, Henry Noye secured the dismissal of Here’s The Plan, LLC, a Philadelphia architectural firm, (“HTP”) from a complex multi-party contractual matter heading to trial in April in the Philadelphia County Court of Common Pleas.

The dismissal was obtained during a 3-part Pre-trial Conference, over a two-day period, that included a successful motion by Henry to preclude plaintiffs’ ability to produce expert testimony due to their repeated violations of court-ordered deadlines. Having prevailed on that motion, the Court then held a Rule to Show Cause Hearing. At the final hearing, Henry successfully argued that HTP was entitled to relief from judgment (non pros) per Rule 237.3 due to the lack of expert testimony critical of HTP.
