Obermayer Litigation Team’s Suit Dismissal Featured in Law360

Matthew Green, Alex Basilevsky, and Samantha Koopman recently secured the dismissal of a suit against their client, a vehicle auction corporation Copart Inc., which was sued for selling a Mack truck that was connected to a workplace injury. The case was highlighted in Law360 in an article, titled “Insurer’s Mack Truck Suit Against Auction Co. Trimmed,” published on July 1, 2022. 

The insurer, Atlantic States Insurance Co., had sued Copart on behalf of the injured employee’s employer, but U.S. District Judge Joseph
F. Leeson Jr. said that under Pennsylvania law, ASIC was only allowed to sue on behalf of the employee. The suit stems from a February 2018 accident in which an employee of Stone Action was seriously injured after losing control of a Mack truck owned by Stone, according to the ruling.
