Ed is a partner in Obermayer’s Business & Finance Department, with a practice focusing on real estate, land development, zoning, subdivision, and general litigation. He represents a diverse range of clients, including developers, property owners, telecommunications providers, automobile dealerships, national healthcare providers, management companies, and residential homeowners in land use and business litigation matters. Ed has served as counsel to a Construction Code Board of Appeals Board.
In his free time, Ed enjoys boating with his family on the Chesapeake Bay and walking in Peace Valley Park. He has coached AAU and CYO basketball and volunteered at his local parish, most recently as Chairman of the Facilities Management Committee. Ed also loves traveling, especially to visit his son in Chile. To avoid embarrassing his son’s Chilean family, Ed is working on becoming fluent in Spanish with a multi-year Duolingo streak.
Ed regularly appears before planning commissions, municipal governing bodies, and zoning hearing boards in all types of land use matters. Ed represents clients in connection with securing amendments to zoning ordinances and handles substantive and procedural challenges to the validity of zoning ordinances and litigates land use matters through the Pennsylvania courts, including many appearances before the Commonwealth Court. Ed has secured approvals for developers for shopping centers, automobile dealerships, retail users and for homeowners needing residential approvals.
Some of Ed’s most notable cases include:
- Defended permit appeals that resulted in a brokered Court approved settlement agreement to permit a methadone clinic over opposition involving hundreds of protestants.
- Secured approvals involving telecommunications towers and uses throughout Bucks and Montgomery Counties.
- Prevailed in litigation that asserted agricultural buildings can be built without permits pursuant to the Construction Code Act. Appeal of Miller, 81 A. 3d 1087; appeal den. 2014 Pa. Lexis 952 (2014).
Some of Ed’s more recent cases include:
- Secured a trial verdict for adverse possession over a disputed parcel of land. Hockman v. Hursh, 253 A. 3d 255 (Pa. Super. 2021).
- Secured a trial verdict to enjoin a public and private nuisance. Litzenberger v. Helverson, (BCCP 2021)
- Forced the removal of an unlawful electronic billboard adjoining a client’s property. McCafferty Hyundai Sales, Inc. v. Middletown Twp. Zoning Hearing Board, 2023 Pa. Commw. Unpub. LEXUS 508; appeal den. 2024 PA. LEXIS 680 (2024)
